Citation Contesting Form
PLEASE READ BEFORE CONTINUING
Pursuant to Cedar Rapids Municipal code ยง61.138(e), a Vehicle Owner who has received an Automated Traffic Citation may either pay or challenge that Citation within 30 days from the date appearing at the top of the Notice of Automated Traffic Citation. To challenge the citation, the Vehicle Owner may either submit a written challenge on a form provided by the City of Cedar Rapids or request that a Municipal Infraction be filed in small claims, naming the Vehicle Owner as defendant.
If you submit a written challenge, a Cedar Rapids Police Officer shall determine whether the citation should be rescinded. Within 30 days after the City receives such a challenge, the City shall notify the Vehicle Owner whether the challenge of the Automated Traffic Citation is successful, in which case, the citation shall be rescinded. Otherwise, the citation shall stand, and the City may seek voluntary payment and/or file a Municipal Infraction against the Vehicle Owner.
If you request that the City file a Municipal Infraction, if the Citation remains unpaid after an unsuccessful written challenge by the Vehicle Owner, or if the Vehicle Owner takes no action in response to the Notice of Automated Traffic Citation, the City may file a Municipal Infraction in small claims court, naming the Vehicle Owner as a Defendant, subject to the statute of limitations and other requirements imposed by Iowa law. If a Municipal Infraction is filed, the Vehicle Owner may also be responsible for court costs and interest as allowed by law, and the City may collect any judgment entered against the Vehicle Owner as allowed by law.
